Terms of Use

• By accessing the Turnkey Tenancy website, Landlord Client Portal, or any related services (collectively, the "Service"), you ("User", "you") agree to these Terms of Use ("Terms"). Please read them carefully before proceeding.
• If you do not agree with these Terms, you may not access or use the Service.

• Turnkey Tenancy ("Company", "we", "our", "us") provides property leasing, tenant placement, and management support services.
• Use of this Service does not in itself create a legally binding representation agreement between you and the Company.
• We do not guarantee the availability of properties, successful matches between landlords and tenants, or leasing outcomes.
• Information, tools (e.g., rent/tax calculators), and listings are provided for convenience and informational purposes only, without warranty of accuracy or completeness.

To use the Service, you must:

• Be at least 18 years old and legally capable of entering into binding agreements.
• Provide accurate, current, and complete information.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of any unauthorized use of your account.

You are solely responsible for all activity under your account, with or without your authorization. We may suspend or terminate any account where inaccurate or fraudulent information is provided.

You agree not to:

• Violate any applicable law or regulation while using the Service.
• Interfere with or disrupt the Service, its systems, networks, servers, or other Users' use.
• Attempt to gain unauthorized access to restricted areas, user accounts, or personal information.
• Use the Service for fraudulent, illegal, or discriminatory purposes.
• Circumvent or avoid paying any applicable service fees.

Certain property data displayed may be obtained from MLS® systems and real estate boards.

• All MLS® data is provided for personal, non-commercial use only.
• You must have a bona fide interest in the purchase, sale, or lease of real estate of the type offered through the Service.
• Copying, redistributing, publishing, broadcasting, scraping, data mining, sublicensing, or otherwise using the listing information for commercial purposes is strictly prohibited.
• The Toronto Regional Real Estate Board (TRREB), The Canadian Real Estate Association (CREA), and other regional boards retain all ownership rights in MLS® databases and content.
• These boards, or their representatives, may audit the Service to ensure compliance with applicable MLS® rules and policies.

• While we strive to ensure information is reliable, we do not guarantee that any listing data, calculator output, property information, or Service content is accurate, complete, or suitable for any purpose.
• All dimensions, prices, specifications, floor plans, and occupancy details are approximate and subject to change without notice.
• Listings and information are provided "as is," and you are responsible for verifying all details independently.

• The Service and all original content, features, design, branding, and software are the property of Turnkey Tenancy or its licensors and are protected by copyright, trademark, and other intellectual property laws.
• Unauthorized reproduction, distribution, modification, scraping, or reverse engineering of any part of the Service is strictly prohibited.
• Realtor®, REALTORS®, MLS®, and associated logos are trademarks owned or licensed by CREA and regional real estate boards, used under license.

We reserve the right, at our sole discretion and without notice, to:

• Suspend or terminate your access to the Service for violation of these Terms or applicable law.
• Remove or modify content, including listings, at any time.
• Restrict use of the Service, including account suspension or permanent ban, with or without cause.

All provisions that by nature should survive termination (e.g., intellectual property rights, disclaimers, limitation of liability, indemnity) shall survive.

The Service may use or link to third-party tools, APIs, or websites.

• We are not responsible for third-party websites or services.
• Your use of third-party content or APIs is subject to their own terms and conditions.
• Links do not constitute endorsement or guarantee.

You agree to indemnify, defend, and hold harmless Turnkey Tenancy, its affiliates, officers, employees, agents, licensors, and partners from any claims, damages, liabilities, expenses, or losses (including legal fees) arising from:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind.

• We do not guarantee uninterrupted or error-free operation.
• We disclaim any warranties regarding accuracy, timeliness, reliability, suitability, merchantability, or fitness for a particular purpose.
• No oral or written statements by Turnkey Tenancy create a warranty not expressly set forth herein.

To the fullest extent permitted by law:

• Turnkey Tenancy is not liable for indirect, incidental, punitive, or consequential damages (including loss of profits, data, or goodwill).
• Our total maximum liability, if any, is limited to the lesser of: (a) the fees you paid to us in the 12 months prior to the claim, or (b) CAD $20.
• Some jurisdictions may not allow certain disclaimers or limitations, so these may not apply to you.

• These Terms are governed by the laws of Ontario, Canada.
• Parties agree to attempt mediation before pursuing legal proceedings.
• Any dispute not resolved by mediation shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
• Class actions are waived: disputes must be brought individually.

• If any clause of these Terms is found unenforceable, the remainder will continue in effect.
• Failure by the Company to enforce any right or provision shall not constitute a waiver.
• These Terms constitute the entire agreement between you and Turnkey Tenancy with respect to the Service, superseding all prior understandings.
• We may assign these Terms without restriction; you may not assign without prior written consent.
